Terms of Service

These Terms of Service ("Terms") explain the rules for using www.tonythemedium.com (the "Website") and for booking and receiving any session, meditation, download or other service from Tony Womersley ("I", "me", "my"). I have tried to keep them as clear and readable as possible.

By using this Website, joining my mailing list or readings waitlist, downloading any free or paid content, or booking a session, you agree to these Terms, to my Disclaimer and to my Privacy Policy. If you do not agree, please do not use the Website or my services.

1. Who I am

This Website and all services are provided by Tony Womersley, a medium, energy healer and spiritual teacher based in St. Thomas, Ontario, Canada. You can contact me at tony@tonythemedium.com.

2. Eligibility

You must be at least 18 years old to use this Website, join my mailing list or book a session. By doing so, you confirm that you are 18 or over and able to enter into a binding agreement.

3. Nature of my services

All mediumship readings, energy healing, spiritual guidance, psychic development sessions, meditations, recordings and other content are provided for entertainment and personal spiritual exploration purposes only. They are not medical, psychological, legal, financial or any other professional advice, and they are not a substitute for care from a licensed professional. Full details are in my Disclaimer, which forms part of these Terms.

4. No guarantee of results

I cannot guarantee that a particular loved one will come through in a reading, that specific information will be received, or that any particular result will follow a session. Testimonials reflect individual experiences and are not a promise of your results. Payment is for my time and the session itself, not for any particular outcome.

5. Booking and payment

Sessions are booked through the online booking system on this Website. Payment is taken in full at the time of booking. When booking, please choose your correct time zone. Sessions are available worldwide and take place in person or online, as described on the booking page.

6. Cancellations and rescheduling

I require a minimum of 48 hours' notice to change or cancel an appointment. To cancel or reschedule, use the link in your original confirmation email, or email me. Cancellations or changes made with less than 48 hours' notice, and missed appointments, are not refundable. If I need to cancel or reschedule a session, I will offer you a new time or a full refund.

7. Booking for someone else

You may book a session for, or gift a session to, another adult only with their knowledge and consent. You are responsible for making sure they have read and agree to these Terms and my Disclaimer.

8. Conduct during sessions

Please treat sessions with respect. I reserve the right to decline a booking, or to end a session early, at my discretion, for example if I feel a reading would not be in your best interest, or if behaviour is abusive or inappropriate. If I end a session for reasons unrelated to your conduct, I will offer a fair refund or a new session.

9. Recording and confidentiality

All sessions are treated with the strictest confidence. Please do not record a session without asking me first. A non-disclosure agreement can be signed if needed.

10. Free meditations, downloads and emails

Free meditations, downloads and emails are provided for your personal, non-commercial use only. They are offered as they are, and I may change or withdraw them at any time. You can unsubscribe from my emails at any time using the link at the bottom of every email.

11. Intellectual property

All content on this Website and in my meditations, recordings, downloads, emails and other materials (including text, audio, video, images, designs and logos) belongs to me or is used with permission. You may use it for your own personal purposes only. You may not copy, share, sell, republish or create derivative works from it without my written permission.

12. Acceptable use of the Website

You agree not to misuse the Website, including by trying to gain unauthorised access to it, interfering with how it works, introducing viruses or harmful code, or using automated tools to copy its content.

13. Third-party links and services

The Website may link to, or use, third-party websites and services (for example booking, payment and email providers). I am not responsible for their content, policies or practices, and your use of them is subject to their own terms.

14. Limitation of liability

To the fullest extent permitted by law, Tony Womersley is not liable for any indirect, incidental, special or consequential loss or damage, or for any loss, injury or distress arising from your use of the Website, my services or my content, or from your reliance on any information you receive. Where liability cannot be excluded, my total liability to you is limited to the amount you paid for the service in question. Nothing in these Terms limits any rights you have under consumer protection law that cannot be excluded.

15. Indemnity

You agree to indemnify and hold Tony Womersley harmless from any claims, losses or costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website or my services.

16. Changes to these Terms

I may update these Terms from time to time. The current version will always be on this page, and the version in place when you book applies to that booking.

17. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of Ontario, unless the consumer protection law of the place where you live gives you the right to bring a claim there.

18. General

If any part of these Terms is found to be unenforceable, the rest will still apply. If I do not enforce any part of these Terms straight away, that does not mean I have given up my right to do so later. These Terms, together with my Disclaimer and Privacy Policy, are the entire agreement between us about the Website and my services.
